Bluepoint Marine Services Ltd is a safety conscious company and set out below are the terms and conditions by which you are required to abide when storing your boat and or working on it whilst it is in the boat yard and your responsibilities relating to your own health and safety and that of others.
WORKING HOURS: 08:30 – 18:00 Mon to Fri and 09:00 – 13:00 Sat (currently closed Saturday)
No use of any Power Tools outside of these working hours
● Only BMS nominated banksmen to direct operations involving all boatyard equipment
● Persons only allowed on vessels during lifts between dock level entry and water.
● Shored boats – props and legs etc. only to be removed/ altered by BMS staff. If you require any assistance, please ask.
● All furling headsails, mainsails, dodgers, spray hoods and other HIGH WINDAGE items must be removed prior to entering the yard.
● All vessels need to unstep the masts otherwise BMS cannot be responsible for insurances in the yard.
● Engines must not be run whilst ashore without prior notice to BMS. This is due to vibration working chocks/ props loose.
● When antifouling, scraping or blasting antifoul – all residues are to be removed and disposed of correctly. All persons to wear correct protective clothing and PPE. NO DRY SANDING.
● Any persons wishing to go aloft on any vessels ashore should first contact BMS.
NB: NO PERSONS MAY STAY ONBOARD AT ANY TIME WHILST THE BOAT IS IN THE BOATYARD
● Please do not throw items off boats and make sure all halyards etc. are taught and secure and not attached to chocks/wedges/shores. Extreme care should be taken when persons wish to go under boats, and no persons are permitted under suspended vessels.
● When boats are in hoist/boat parker, owners and crew are asked to keep well clear and not to enter the work area unless instructed by the BMS banksman, if this is allowed, they must all be wearing the necessary Personal Protective Equipment.
● Ladders- Owners to supply their own ladders and ensure they are securely fixed to your vessel, tied with no side to side movement and both feet of ladder are touching the ground. All ladders must be locked to their respective vessel at all times. Ladders left unlocked will be removed and if not claimed within 4 weeks disposed of.
BMS accepts no responsibility for replacement of such items.
● Vehicles may only enter the yard with permission to load/unload. Extreme care must be taken when manoeuvring. Any damage incurred to vehicles whilst in the yard or in the entrance to the yard/ dock launch area will not be the responsibility of BMS. The car park across the road is for staff parking only and BMS does not allow parking within the boat yard.
● Upon Hoisting a vessel, the strop position must be agreed by the owner before commencing the lift.
● BMS require the rights to move vessels in their possession by either boat handler, hoist of Forklift.
Contractors
● Any contractor wishing to work on boats in the BMS yard must register with us each day before commencing any works.
● Any contractors must provide evidence of their insurance BEFORE works commence.
● Any dangerous operations or hot works must be discussed with BMS before works commence. We will aid you in working safely and help you produce Risk Management strategies if necessary.
Blasting
● Shot blasting, high pressure blasting etc may only take place with our consent in a designated area. We would require 48 hrs notice of such activities.
Polyurethane Paint
● Two pack paint products can be very hazardous to health. Please inform us if you intend using such products and follow any manufactures guidelines. Spraying cannot be carried out without our consent.
The Price and Payment
1. The price of the service provided shall be the price agreed between BMS and the Customer, at the time the Customer agrees to work being carried out. This price may vary, dependent upon any change in parts prices, or change in specialist charges, which may come into effect at the time the work is completed and which is beyond the control of BMS. The price of the work carried out is inclusive of VAT and exclusive of VAT for Commercial Customers. Where applicable, VAT shall be due at the rate ruling on the date that the VAT invoice is drawn.
2. Payment shall be due at point of collection/delivery of vessel following completion of repairs, unless otherwise agreed, in writing, with BMS. Payment in this instance is generally agreed to be 28 days from date of invoice.
3. BMS shall have a general lien on all of the Customer’s vessels and all of their contents for all monies owing to BMS by the Customer on any account whatsoever. BMS shall be entitled to reasonable storage charges during any period in which the vessel is retained by virtue of the lien.
4. If the Customer’s indebtedness to BMS is not satisfied within 28 days from the date of the first invoice to the Customer, BMS may without notice sell any vessel owned by the Customer and/or the contents thereof by public auction or private treaty. The net proceeds of the sale shall be applied towards the satisfying monies due from the Customer to BMS, and any balance shall be paid by BMS to the Customer on demand.
5. UPON DELIVERY OR COLLECTION OF YOUR VESSEL PLEASE INSPECT AND CONFIRM WITHIN 24 HOURS ANY DAMAGE YOU FEEL IS THE RESPONSIBILITY OF BLUEPOINT MARINE AND REPORT IT IMMEDIATELY.
